A rent-determination action seeks to bring the rent of the renewed period closer to the market. Comparables must be comparable in location and use. An equity reduction cannot be applied without reasons.
In dwelling leases that have not yet run five years, statutory caps on increase must be read together with the determination action. In commercial leases contractual freedom is wider; an adaptation action is a separate path and depends on a fundamental disturbance of the economy of the contract.
